| TICA Classifieds Advertising Terms and Conditions 1 In these terms and conditions, 'Publisher" means TICA Default Tenancy Control Pty Ltd and includes its officers, employees and agents. "Advertiser' means the person or organization placing the advertisement. These terms and conditions shall apply to and form part of each order for advertising placed with the Publisher. 2 All advertisements and advertising material are subject to the approval of the publisher and are accepted subject to the conditions of the Trade Practices Act, 1974. 3 The publisher reserves the right to reject and remove any advertisement considered unsuitable for publication. 4 If the advertisement does not appear in the specified position, the publisher will relocate the advertisement when advised by the advertiser. 5 The publisher accepts no liability for any loss caused through misplacement of any advertisement. 6 It is the responsibility of the advertiser or agent to notify the publisher within 7 days of the publication Issue date of any error in the advertisement. The publisher is not responsible for recurring errors. 7 The Publisher reserves the right to cancel or suspend any advertisement at will. 8 The publisher reserves the right to delete any advertisement when the time period for such advertisement has expired without notice to the advertiser. 9 The advertiser warrants that the advertisement is true and correct at the time of publication and that the advertiser will as soon as the possible delete the advertisement when they have obtained what they want or what they were selling. 10 The advertiser warrants that in the event they are advertising a position vacant such position is vacant at the time of advertising. 11 The advertiser agrees that should they type any information that is offensive discriminatory and or breaches any state or federal law the advertisement will be removed by publisher and any membership of the publisher will be cancelled without refund. Trade Practices Act, 1974 The advertiser hereby indemnifies and agrees to hold indemnified the
publisher, its servants and agents and each of them against all liability,
claims or proceedings whatsoever which may arise from the publication
of any material pursuant to the order, and in particular but without limiting
the generality of the foregoing to indemnify and hold indemnified each
and all of them against any action for defamation, slander of title, breach
of copyright or infringement of any trade mark, name or description, invasion
of any trade mark, name or description, invasion or privacy or breach
of any provision of the Trade Practices Act, 1974, |
